The mess with the works that have passed into the public domain this year in Spain. ‘Sherlock Holmes’ is not among them: he did it years ago

A public domain work is one that anyone can distribute, sell, or alter. without the permission of the rights holders (the author or his heirs), as such rights have already expired. And how do we know if they are extinct? Well, it’s complicated: In general, they do it 70 years after the author’s death.

But in Spain, for those authors who died before December 7, 1987 (even if they are not Spanish), said term is 80 years. And having said that, there are a whole series of legal factors to take into account for specific cases, as this article from CEDRO (the Spanish publishers’ and writers’ rights management company) explains.

In any case, those years are not counted exactly from the day of the author’s death: the work it is not released until January 1 of the year following the year in which the 70/80 anniversary is fulfilled. Which means that every January 1, thousands of works are free of rights, en bloc. And here we go, what works were free of rights two days ago, with the start of this new year?

What about ‘Sherlock Holmes’?


Possibly, you have read on multiple Internet sites these days that the ‘Sherlock Holmes’ novels (only novels, this does not affect movies and series) are part of the works that have entered the public domain this year. And indeed, that is so… in the United States, but not in Spain.

Many of the lists of new works in the public domain disseminated on the Internet echo the criteria of United States legislation, very different from that of Spain.

In the North American country, a Law for the Extension of Copyright Terms of 1998 caused the passage into the public domain of certain works published in 1927 to see their validity extended for another 20 years… but that does not affect us. For the following reasons:

  1. In Spain, we repeat, copyright is not counted by date of publication of the workbut of the author’s death.

  2. Arthur Conan Doyle, creator of the immortal British detective, died in 1930. 92 years ago already.

  3. In Spain it could only be extended beyond 80 years of copyright protection if the law in force in the author’s native country (UK, in this case) I would too… and if said country were a member of the EU.

  4. The aforementioned ‘Copyright Term Extension Law’ is American, not British. And even if she was British, well… would have ceased to apply here when the UK left the EU.

In these times in which so many applications and platforms receive names in English or derived from it, ‘Loquendo’ is, on the contrary, a word derived directly from the Latin: it is the gerundive (future participle) of the verb ‘loquor’ (to speak), and can be translated as ‘what will be spoken’ or ‘what is speakable’. But don’t worry, the beginning of this story does not go back to Julius Caesar and Cicero, but only to the mid-70s. Although, yes, it is also located in Italy.
