Hate speech: Twitter must also delete analogous false statements

The district court of Frankfurt am Main today tightened the deletion obligations of Twitter. The company not only has to remove untrue or defamatory contributions, but also analogous comments with an identical core of the statement as soon as knowledge of this content exists.

This is what the judgment (Az. 2-03 O 325/22) of the district court in Frankfurt am Main says in an urgent procedure. The anti-Semitism commissioner of the state of Baden-Württemberg, Michael Blume, had sued. In September 2022, according to the district court, various Twitter comments claimed that he had “closeness to pedophilia” and he has “made a fling“. In addition, it was rumored that he was in “anti-Semitic scandals” entangled and he was “Part of an anti-Semitic pack“. However, the judges consider these allegations to be untrue and defamatory.

To describe someone as an anti-Semite is initially an expression of opinion; In this case, according to the court, it was no longer about public opinion. Rather, the comments would aim to “to create sentiment against the anti-Semitism commissioner in an emotionalizing way“. In this context, the contributions were therefore assessed as illegal.

No monitoring obligation for Twitter

So Twitter shouldn’t have redistributed the comments when they were reported. And this applies not only to posts with the same content, but also to “such comments that are to be regarded as equivalent and which, despite certain deviations, have an identical core of the statement“, says the statement.

This does not apply to deviating statements. In the case of the anti-Semitism officer, for example, this applies to his inclusion on the list of the largest anti-Semites in the world published by the Wiesenthal Center in Los Angeles – users are allowed to point this out.

However, the judgment does not mean that Twitter must now check all posts. “Twitter is thus in no other position than when a specific infringement is reported. In this case, too, Twitter must check whether this legal infringement requires deletion or not‘ said the presiding judge of the district court.

The judgment is not yet final. It can be contested with an appeal to the Higher Regional Court in Frankfurt am Main. However, the direction of the judgment is not new. The Frankfurt Regional Court had already ruled in April that Facebook had to remove memes with the same false quotes without further notice.

Conflicting with Musk’s Twitter course

The process was supported by the organization HateAid. The lawyer for the plaintiff Chan-jo Jun describes the verdict in this test case as a success. Now the rule of law is required to “If necessary, to force Twitter with a fine and imprisonment to finally install effective protection of personal rights“, says Jun.

What the judgment also reveals: It contradicts Elon Musk’s course. This reads: freedom of speech, not freedom of reach. So instead of deleting posts, he wants to limit the reach of hate speech cases. In the future, however, it is likely to collide with both German and EU law.
